FRA was retained to support an International Aerospace and Defence corporation (market cap: over $100 billion) and its team of international law firms to conduct a multi-year forensic accounting and eDiscovery review within the context of a large multi-national bribery and corruption investigation reporting to three investigative authorities: UK Serious Fraud Office (SFO), the US Department of Justice (DOJ) and French Parquet National Financier (PNF). The assignment presented complex issues requiring bespoke solutions to navigate state secrecy laws as well as managing multi-jurisdictional data privacy regulations. We also had to support different cases or “workstreams” managed by seven different law firms within the larger investigation, while consolidating all non-sensitive data to one location for review and reporting.
Due to blocking statutes relating to France, Germany and Spain, the eDiscovery review required us to install five Mobile Discovery Solutions, each with its own air-gapped environment, ensuring there was no internet connection and was unable to be hacked. In addition to being in a secure location, we created controls that would prevent the FRA team supporting the Mobile Discovery Solution from seeing the data, allowing instead for the company to first review and release data that was not deemed to be state secrets. This process was required to be compliant with the various national regulators – the PNF, SFO and DOJ.
To support 50 different “workstreams”, we devised a solution that built in Relativity Analytics, thereby creating the largest analytics case supported by Relativity. Over 55 million documents from 700+ custodians relied on Relativity Assisted Review to help identify relevant documents in the most cost effective and efficient manner. In this way, we effectively served the needs of stakeholders within the company up to C-suite levels, as well as assist various international legal teams to respond to requests from multiple regulators.
The forensic accounting review covered events occurring over 12 years within the company’s three major business divisions, 20+ legal entities and across a dozen countries. The eDiscovery review covered multiple air gap mobile discovery solutions allowing the review of 55+ million documents across 700+ custodians. The investigation involved liaison with a wide range of stakeholders within the client company from finance staff to the C-suite, as well as working with several international legal teams to answer multiple regulators requests.
