Sedona Conference 2017 'Key Insight' - How to transfer data pre GDPR in a global investigation

With the past year seeing significant developments in data privacy regulation, the central topic of the Sedona Conference's recent International Program on Cross-Border Discovery and Data Protection was the General Data Protection Regulation (GDPR).

GDPR will be replacing Data Protection Directive 95/46/EC and will provide consistency across all EU member states. GDPR preserves the core principles and the adequacy criteria of the Directive but aims to simplify the process for methods of cross-border transfer of data and ensure security.

One of FRA's founding partners and FRA's head of eDiscovery, Greg Mason, outlines in The Lawyer the key changes of the new GDPR and discusses the best methods of data transfer including, Individual Consent, Binding Corporate Rules (BCRs), Standard Contractual Clauses, Mutual Legal Assistance Treaty and Privacy Shield.
