A June 3, 2026 Executive Order directs DHS, CBP and the Attorney General to strengthen customs enforcement. Among other things, it directs DHS to bolster enforcement of customs laws, regulations and other mandates such as Customs-Trade Partnership Against Terrorism, and calls for more audits and harsher penalties. The EO also directs the Attorney General to prioritize enforcement of laws concerning imports made with forced labor, misclassification, undervaluation and illegal transshipment. It is widely expected that there will be more aggressive enforcement in the coming months.

While there are several legal theories the government can apply, the False Claims Act (FCA) is increasingly used as a tool to enforce actions against corporations engaging in customs fraud through tariff evasion or misreporting, through investigations initiated by the DOJ or by “whistleblowers” who may be competitors or “disgruntled” employees.
