The US Department of Justice's (DOJ's) Foreign Corrupt Practices Act Pilot Program (FCPA) states that if a company voluntarily discloses an FCPA misconduct, participates in appropriate remediation, and offers full cooperation then it is eligible for reduced fine and may be considered for a declination. There is no question that FCPA prosecutions have skyrocketed over the past ten years.
